Welcome to Evallo.app, a software-as-a-service (SaaS) platform that enables users to create, share, and analyze interactive forms, evaluations, and conversational experiences. These Terms and Conditions (“Terms”) govern your use of the website, applications, and services provided by Evallo Technologies Pvt. Ltd., a company incorporated in India (“Evallo”, “we”, “our”, “us”).
By accessing or using Evallo, you agree to be bound by these Terms. If you do not agree, please do not use the service.
1. Eligibility
You must be at least 13 years old and legally able to enter into a contract in your jurisdiction to use Evallo. If you are using the platform on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.
2. Description of Service
Evallo provides tools to build conversational forms, quizzes, and evaluations using a visual drag-and-drop interface. The platform supports free and paid plans. Paid features include enhanced customization, analytics, integrations, and storage limits.
3. Account Registration
You may be required to register for an account to access certain features. You agree to:
Provide accurate information,
Keep your login credentials secure,
Be responsible for all activities under your account.
Evallo is not liable for losses caused by unauthorized use of your account.
4. User-Generated Content
You retain ownership of all content you create using Evallo, including forms, evaluations, text, images, and logic (“User Content”). However, by creating or sharing content through the platform, you grant Evallo a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content for the purpose of operating the service.
You represent that your User Content does not violate any law or third-party rights.
We reserve the right to remove or restrict access to content that violates these Terms or is deemed harmful, abusive, illegal, or misleading.
5. Acceptable Use
You agree not to:
Use the service for any illegal or unauthorized purpose,
Interfere with or disrupt the service or servers,
Reverse engineer, scrape, or exploit the platform without written consent,
Upload viruses, malware, or harmful code,
Harass, abuse, or harm other users.
We reserve the right to suspend or terminate accounts that violate our policies.
6. Payments and Subscriptions
Evallo offers both free and paid plans.
Payments are processed through Stripe. All prices are in USD unless otherwise specified.
Paid subscriptions auto-renew unless canceled before the end of the billing cycle.
No refunds are provided unless required by law or explicitly stated in a written agreement.
You are responsible for all applicable taxes.
7. Termination
You may stop using the service at any time. We reserve the right to suspend or terminate your account without notice if:
You violate these Terms,
We are legally required to do so,
We discontinue the service (with reasonable notice to active subscribers).
Upon termination, your access to the service will cease, but we may retain certain data as required by law or for internal business purposes.
8. Intellectual Property
All rights in the platform, including code, branding, features, and design, belong to Evallo or its licensors. You may not copy, modify, or distribute any part of the platform without permission.
Trademarks, logos, and content owned by third parties are used with permission or under applicable law.
9. Third-Party Services
Evallo integrates with third-party tools such as:
Stripe for payment processing,
Google Analytics and Posthog for analytics.
Use of these services is governed by their respective privacy policies and terms. Evallo is not responsible for third-party service failures or data use beyond our control.
10. Disclaimers
Evallo is provided on an “as is” and “as available” basis. We do not guarantee:
That the platform will be uninterrupted or error-free,
That your use will result in specific business outcomes,
The accuracy or reliability of any user-generated content.
You use the service at your own risk.
11. Limitation of Liability
To the fullest extent permitted by law, Evallo shall not be liable for:
Any indirect, incidental, or consequential damages,
Loss of data, profits, or goodwill,
Any claim exceeding the amount paid by you in the past 12 months.
This limitation applies regardless of the legal theory and even if we were advised of the possibility of such damages.
12. Indemnification
You agree to indemnify and hold harmless Evallo and its affiliates, officers, employees, and agents from any claims, damages, or losses resulting from:
Your violation of these Terms,
Your use of the platform,
Any content you submit or create.
13. Changes to the Terms
We may modify these Terms at any time. If we make material changes, we will notify users via email or by posting a notice on the platform. Continued use after such changes means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.
